In the past year, Baltimore County Attorney Adam Spence was hired by three clients to protect their interest in a house “purchased” by agreement, but held in the name of a deceased relative.

The Unwritten Agreement

Prior to the relative’s death, the relative agreed to give the House title to the clients if they paid off the mortgage and all taxes on the property.  

The clients paid on the mortgage for over 10 years and ultimately paid it off with a six-figure lump sum payment.  Unfortunately, the relative died before re-titling the house.  Making the situation worse, there was no written agreement.

Blatant, Unrestrained Greed by the Relative’s Heirs

Adam filed an extensive lawsuit seeking the Court’s re-titling of the house and other relief.  Not only did the Estate oppose the relief sought, the Estate filed an eviction action seeking to remove his clients from the house for which they paid in full!   However, Adam was able to use complex court procedures to have the eviction proceedings effectively dismissed pending the resolution of the Circuit Court lawsuit.

Happily Ever After

After a long and drawn out battle, in which Adam used several discovery tools to improve his client’s position considerably, Adam was able to negotiate a settlement agreement giving his clients title to the house while avoiding the considerable expense of trial.
