Landlord / Tenant Disputes

The firm represents landlords of houses, shopping centers, commercial office buildings and warehouse space in matters related to residential and commercial real estate leasing, contracts and litigation. The firm’s representation includes lease drafting and negotiation, enforcement of lease agreements, eviction and rent collection proceedings. Should a tenant file for bankruptcy protection, the firm also represents landlords during the bankruptcy, ensuring timely payment of rents, moving for allowance and payment of administrative expense priority claims (including attorneys’ fees incurred), as well as moving to compel rejection or assumption of leases and/or for relief from the automatic stay, as appropriate

Notable successes include:

After a two week trial, the firm defeated a tenant’s claim against the Landlord for nearly $137 million in claims including retaliatory eviction, discrimination, intentional infliction of emotional distress, and many other claims.

After a three day trial, the firm obtained a $249,000 judgment for its client in a commercial constructive eviction case after the landlord failed to take required steps to renovate the premises after a fire.

The firm obtained a summary judgment ruling on a $300,000.00 suit brought against one of our landlord clients in a matter concerning the application of an exclusive clause in a commercial lease.
